Bill Janklow, a former congressman and four-term governor, can return to the practice of law on Feb. 15, the South Dakota Supreme Court ruled Thursday. The 4-1 decision, made by a substitute high court of five circuit judges appointed to handle the case, means Janklow will be reinstated to practice law about a year before his probation ends for second-degree manslaughter and other offenses related to an August 2003 crash that killed a motorcycle driver.

I used to consider myself of the "fiscal conservative social liberal" persuasion but I'm ashamed at our representatives in what's come out of this Abramoff and Delay scandal.

These guys and everyone around them thinks they did nothing wrong. They're taking vacations to meetings in Scottland to play golf. Going to tropical islands on lobbyist-supplied private jets, etc.

The main guy is called "The Hammer".

And I ask you, what does any of this stuff have to do with representing the average American?

They say you can tell lots about someone by who's company they keep. These guys don't give a hoot about 95% of us. sad really.

I doubt a mass mailing would have any effect anyway. He seems a bit smug and self-satisfied.

I just got off the phone with the lawyer/pillion. Her advice is to take this to the Ethics Committee of the SD State Bar Association. Just because he has been reinstated by a court does not absolve him of responsibility. I'm sure there is more to this than has been reported, but she seems to think it's worth pursuing. Too bad she's not licensed in SD.

First may I point out that Janklow has not made his living practicing law but being a politician.

Second, he is not getting out of jail because he is a lawyer, but because he is a politician.

Third, it was a lawyer that prosecuted him and sent him to prison.

Fourth, he should stay in prison longer that Average Joe because he is a politician.

Lawyers are like tire repair kits fellows. You never appreciate one until you need one. Now politicians, what do we really need them for? ;)

if you picked b. what are you going to do? mass mail him, like he cares. His handlers get the mail. Avoid SD, and punish all of SD. Last time I heard SD could use some tourism dollars. Punish the short order cooks by not buying breakfast when you don't visit.

The Bush (Haliburton) goverment is killing more young people every day than Janklow has by putting them in harms way in Iraq for a false war. That deserves an action, for me that means I'm avoiding Texas.

There is law and there is justice. The law was served. What would serve justice in this case?

At the time the verdict came down the family of the victim accepted the decision of the court. They wanted to move on and grieve the loss they suffered. At what point are we hijacking their lives, their loss, and their grief for our own sense of indignation for the gap between what the law demands and justice cries out for?

I'm sorry, too, Brad. I have expressed my opinion on this issue before, so briefly:

He was convicted by a jury of people from his home town. The judge alone determined the sentence. His 100 day sentence in jail had the provision for work release (charity work) after 50 days if he chose to do so. He didn't. He sat on his fat butt in jail for the 100 days.

The Scott family is pursuing the suit against him in the Minnesota courts, but he won the ruling that he was on government business, so the US taxpayers, not Janklow, will pay any settlement.

While he was in politics (He served as state's attorney, SD Attorney General, Govornor, and as US Representative) he has a reputation of being one of the best trial lawyers in the state and did earn his living as a attorney for many years when not in office.

The reinstatement was done by substitute judges because the current SD Supreme Court contains only judges that were appointed by Janklow when he was govornor.

The above is fact that can be verified.

My opinion is that Janklow is more than smug. He is arrogant. He is a Jerk. He has never, to my knowledge, appoligized to the Scott family and continues to behave as if he did nothing wrong. He blames the "accident" on his insulin dependent diabetes and not having the right meal earlier that day. NOTHING you all may do will change his mind, he is right (HE thinks) and so you are all irrelevant (HE thinks).

As I have said before, IF you, like Brad, choose to avoid South Dakota, I understand. There are lots of great people who live in this state. That is why it amazes me that almost half of them still support Janklow and would vote for him again. This is why I don't think taking this to the Ethics Committee of the SD State Bar Association would help. They are all his buddies or owe him favors.

I was disappointed that he got only 100 days and I am now sad that he got his licence back early.

As a lawyer following this story and this thread I have to agree with plainsscout.
In my universe if you have to go to court to get reinstated it is because the state bar governing body has declined to reinstate him.Wonder if anyone closer to the true facts knows about that?
For me,the fact that Janklow screwed up cannot lead to this sickness called "Everybody in the justice system is corrupt so lets kill em all especially him,but any lawyer will do".
That is vigilantism,folks,which is the precursor to the lynch mob.Black men were lynched in the midwest(Indiana?) as late as the 1950s,I believe.
By the way,Canada,America,Britain,India,Australia and many other countries share a common law legal system which is centuries old and very cognate.So don't get on a high horse about foreign lawyers having an opinion.

although it really bugs me that this man is so unrepentant for his actions, i really can't see avoiding a state doing much good. to me, "states" (their geography, their people, their attractions) really should transcend their politicians and if i find something super cool that i want to do in S. Dakota than i'll probably still do it.

Sorry, but just because a state has a rotten politician isn't going to keep me away. Hell, we have a couple in ND that I don't care for much either, but I still live here and pay taxes. They haven't killed anyone yet, though. :laugh

SD has some of the best riding in the upper midwest, if you hit the Black Hills during the non-tourist season. I've left tons of money down there, and will keep doing so. I also have a daughter living and going to school in Rapid City, and she absolutely loves it there. She will be marrying and moving on to Kansas City in August, but has mentioned that someday she would like to be back in the Black Hills. In fact, I could just see myself living in there someday.

As a Canadian I really have minimal knowledge regarding the situation. However, Mary and I have travelled most of the United States and no matter what our preconceived notions were we always (Always) found good folks and beautiful geography. Travel has a way of breaking down narrow mindedness and we thank everyone that we have met for allowing us a balanced view of a great nation. Damn.....I think I'm gonna break into song! :usa -Bob

Last night Frontline on the Public Broadcasting Channel did an in depth report on the fantastic profits that banks are earning on credit cards. The trend to high interest rates that supercede any national governance was started by none other than Bill Janklow. As economic development he allowed SD to become a haven for predatory lenders. The trend now casts its shadow over us all.

While I think Governor Rounds is mostly a good man, I doubt that you will ever get a responce to your letter. :banghead You're not a SD voter and the attendance at Sturgis last summer wasn't down at all.

Former South Dakota Gov. Bill Janklow, who served 100 days in jail for killing a motorcyclist in a traffic crash, died of brain cancer on Jan. 12. He was 72.

In 2003, Janklow was sentenced to 100 days in jail after being convicted of felony manslaughter for driving a car through a stop sign at a speed estimated at more than 70 mph into the path of motorcyclist Randolph Scott, 55, of Hardwick, Minn. Scott died at the scene.

Janklow also lost his driver’s license for three years, was placed on probation for three years and was ordered to pay $11,000 in fines in costs.

The Associated Press reported that Janklow announced at a news conference in November that he had inoperable brain cancer and his only regret was running the stop sign and killing Scott.
